On May 21, 2004, the State of Hawaii (the State) charged Tamashiro by way of oral arraignment in district court with the offenses of Obedience of Police Officers, in violation of Hawaii Revised Statutes (HRS) § 291C-23 (1993), and Reckless Driving, in violation of HRS § 291-2 (Supp. 2006). After a bench trial, the district court convicted Tamashiro of Reckless Driving.
